REFORM OF THE GENERAL PART AND THE SYSTEM OF SANCTIONS IN THE NEW PENAL CODE OF THE REPUBLIC OF CROATIA

Abstract

The paper is devoted to the most significant novels in the Penal Code of the Republic of Croatia (2011). The author begins with discussing the new concept of guilt and the principle of culpability, and then examines the distinctions between perpetration and complicity, as well as criteria of attempt at an offence and abandonment of an offence. Special attention is paid to the reform of the criminal sanctions system. The author thoroughly analyses the novel fifty-year imprisonment, comparing it with other possible means of the deterrence of the most dangerous offenders. Provisions of both substantive and procedural criminal laws purposed to reduce the overcrowding in prisons are dealt with. The new model of the fine based on daily rates is detailed. The above mentioned issues considered, the ways of the further improvement of the Croatian penal legislation are outlined.
